MBMEMORY holds the rights to the MYWIE mobile and web application.
2. Definitions

3. Acceptance of Terms
The use of the MYWIE application implies full and complete acceptance of these General Terms of Use.
Access to the service is subject to the creation of a personal account and express validation of these Terms.
In case of non-acceptance, the user agrees not to use the application.
The Terms may be modified at any time. The user will be informed by email in case of substantial modification.
4. Service Description
MYWIE is a digital platform allowing users to:
- Create an inverted family tree oriented towards descendants
- Write a multimedia narrative journal (texts, photos, videos, sounds)
- Schedule scheduled messages triggered by future events
- Secure sensitive content in an encrypted Vault of Silences
- Manage the transmission of their digital data after death
The service is freely accessible (freemium), with paid premium features.
5. Account Creation and Management
Access to MYWIE requires the creation of a personal account, via email address and password.
The user agrees to provide accurate, up-to-date and complete information.
Each account is strictly personal. Sharing credentials is prohibited.
The user is solely responsible for the confidentiality of their credentials.
They can delete their account at any time via the interface, in accordance with their post-mortem directives.
6. Personal Data
In accordance with the GDPR and the Data Protection Act, MBMEMORY scrupulously respects user privacy.
Data collected:
- Identity (first name, last name, date of birth)
- Contact details (email, phone)
- Uploaded content (messages, videos, files)
- Data relating to designated beneficiaries
Purposes:
- Service operation
- Conditional transmission
- Post-mortem support
- Compliance with digital directives
Retention period:
- Active account: duration of use + 10 years
- After confirmed death: according to defined settings
- Requested deletion: immediate, except legal obligations
7. User Rights
Each user has the following rights:
- Right of access to their data
- Right to rectification of inaccurate data
- Right to erasure ("right to be forgotten")
- Right to restriction of processing
- Right to data portability
- Right to object to processing
These rights can be exercised by email to: dpo@mywie.fr, accompanied by proof of identity.
8. Data Security
MBMEMORY implements appropriate technical and organizational measures to ensure data security.
Measures taken:
- Hosting exclusively in France (OVHcloud, European Union)
- AES-256 encryption for sensitive content
- Enhanced authentication (strong password, optional two-factor authentication)
- Strict access control to databases
- Logging of access and modifications
Despite these measures, no system is invulnerable. The user is informed of this.
8.bis Encryption at rest of sensitive content
MYWIE encrypts sensitive content at rest (Vault of Silences, scheduled messages, private journal) with AES-256-GCM. The decryption key is derived from the User's password and recovery phrase (PBKDF2). Stored data remains encrypted; decryption occurs only in an authenticated session to provide the requested service.
- AES-256-GCM encryption at rest: sensitive content is encrypted before database storage. Servers keep encrypted data; plaintext is not persisted.
- Password-derived key: on login, the password derives the master key in session. A 12-word recovery phrase completes the setup. No plaintext password copy is retained.
- Technical access limited to the service: MYWIE does not use content for commercial, advertising or model-training purposes. Technical access to plaintext occurs only to operate the subscribed service (display, backup, explicitly enabled features such as local narrative AI or local transcription).
- Recovery under the User's responsibility: the triple safety net (password, recovery phrase, trusted person) is under the User's control. Losing all factors at once may make encrypted content unrecoverable.
The User acknowledges that, because of encryption at rest with a derived key, MYWIE cannot restore encrypted content if all recovery factors have been lost. This limitation is the counterpart of stronger protection.
9. Transmission After Death
MYWIE allows planning the transmission of digital content after the user's death, in accordance with Article 85 of the Law of June 20, 2018.
Transmission is subject to:
- Confirmation of death via official source (death certificate, civil status API)
- Or validation by two designated witnesses
- Or prolonged account inactivity (configurable)
The user can define conditional transmission rules:
- On a specific date (e.g.: recipient's 18th birthday)
- On a future event (wedding, graduation)
- By logical combination (AND/OR)
Beneficiaries receive a secure notification with a temporary access link.
10. GDPR Compliance
MBMEMORY acts as data controller.
A Data Protection Officer (DPO) is designated: dpo@mywie.fr.
Transfers outside the EU are strictly prohibited. All data is hosted in France.
In case of data breach, MBMEMORY commits to notifying the CNIL within 72 hours, as well as the affected users.
11. Intellectual Property
The following elements are protected:
- The domain name mywie.fr
- The MYWIE logo (golden tree + MV)
- The user interface, icons, design
- The application source code
All these elements are the exclusive property of MBMEMORY.
Any reproduction, even partial, is strictly prohibited without written authorization.
Content published by users remains their property. They grant MBMEMORY a non-exclusive, worldwide, free license to use this content for the operation of the service.
12. Limitation of Liability
MBMEMORY cannot be held liable for:
- Indirect damages related to the use of MYWIE
- Inaccuracy or obsolescence of data entered by the user
- Temporary interruptions due to updates or maintenance
- Hacking attempts despite security measures in place
- Decisions made by beneficiaries following receipt of a message
The user acknowledges using the service under their sole and entire responsibility.
13. Duration and Termination
These Terms take effect from their acceptance and apply for the entire duration of use of the service.
The user can close their account at any time from their personal space.
MBMEMORY reserves the right to suspend or terminate an account in case of violation of the Terms, fraud or misuse.
Account deletion results in permanent deletion of data, except for contrary legal obligations.
14. Modification of Terms
MBMEMORY reserves the right to modify these Terms at any time.
Modifications will be notified by email at least 15 days before their entry into force.
If the user does not accept the new Terms, they can close their account within the allotted time.
Continued use of the service constitutes acceptance of the new conditions.
